Our service is to facilitate online language training between registered language teachers and registered language students. All users agree that MIND THE GAP EDUCATION GROUP Ltd. or any employee of MIND THE GAP EDUCATION GROUP Ltd is not responsible for the provision or quality of any service provided by a language teacher to a language student, and that the web site functions solely as an intermediary between registered language teachers and registered language students. All registered language students agree to MIND THE GAP EDUCATION GROUP Ltd acting as agent for them for the purpose of booking lesson time with a language teacher. Language teachers and language students contract directly with each other with MIND THE GAP EDUCATION GROUP Ltd. facilitating the transaction on the part of the language student.
- These terms and conditions may be changed at any time. Your use of MIND THE GAP EDUCATION GROUP Ltd. will be deemed to constitute acceptance of any variation of these terms and conditions. All users are responsible for the content and accuracy of any information supplied by them. All users agree to release MIND THE GAP EDUCATION GROUP Ltd. from any claim, demands and damages of any kind which arise due to reliance on inaccurate information held on the MIND THE GAP EDUCATION GROUP Ltd. website, systems and supporting infrastructure.
- All users agree to release MIND THE GAP EDUCATION GROUP Ltd, its officers, directors, employees, agents, affiliates and third parties, from any liability for loss arising from the use of MIND THE GAP EDUCATION GROUP Ltd. All users agree to release MIND THE GAP EDUCATION GROUP Ltd, its officers, directors, employees, agents, affiliates and third parties, from any liability, resulting from the acts or omissions of other users (including unauthorized users, or "hackers") MIND THE GAP EDUCATION GROUP Ltd.
- MIND THE GAP EDUCATION GROUP Ltd. reserves the right to close the account of any user for any reason. No refund, payment or compensation of any kind will be made to a user whose account has been closed due to breach of these terms and conditions.
All users agree not to publish or place computer code of any kind on MIND THE GAP EDUCATION GROUP Ltd. without our express permission.
All users agree not to distribute or share their account login details.
All users certify that they can form legally binding contracts under their applicable law.
Users must not use copyright material, trademarks or other protected proprietary information in any way without the written consent of the owner of such material.
The creation of a student account requires you to provide personal information. All language students agree to the use of their personal information in accordance with the web site privacy policy.
The creation of a tutor account requires you to provide personal information and create a personal tutor profile. All language teachers agree to the use of their personal information in accordance with the web site privacy policy.
All language students must book lesson time with a registered language teacher through their MIND THE GAP EDUCATION GROUP Ltd account. Students must select available lesson time from a language teacher's work planner and make payment of all fees necessary to complete our booking process. Language students are liable directly to the language teacher concerned for the total published fee per lesson, less any amount already paid to MIND THE GAP EDUCATION GROUP Ltd. Any action or communication by a language student with the objective of avoiding our fees, our booking process or to arrange lessons outside of MIND THE GAP EDUCATION GROUP Ltd, is strictly prohibited and will result in the closure of the account of the student and teacher concerned and legal action taken for the recovery of monies deemed owing.
We reserve the right to alter or amend our fees at any time. All prices displayed publicly on MIND THE GAP EDUCATION GROUP Ltd are inclusive of all fees.
Should any amount owed to a tutor by a student remain unpaid by a student, we reserve the right to charge the payment method used by the student to book their classes for the purpose of reimbursing the tutor concerned.
Students may reschedule or cancel a lesson through their account up to 24 hours before the lesson is due to commence.
No refund of fees paid will be made for lessons canceled by a student. Where a student cancels or fails to attend a lesson, they shall remain liable to the language teacher concerned for the total published fee per lesson, less any amount already paid to MIND THE GAP EDUCATION GROUP Ltd.
Where a language teacher cancels a lesson, students shall be entitled to a full refund of any payment made for that lesson.
All registered language teachers agree that the contract for the provision of language training services is between themselves and a registered language student, and that they are solely responsible for the delivery and quality of any service they provide to a language student, and for invoicing a language student for the total published fee per lesson less any amount already paid to MIND THE GAP EDUCATION GROUP Ltd.
All registered language teachers agree that MIND THE GAP EDUCATION GROUP Ltd.
MIND THE GAP EDUCATION GROUP Ltd. or any employee of MIND THE GAP EDUCATION GROUP Ltd. is not liable for any amount a registered language student fails to pay them.
All language teachers warrant that they are self employed and responsible for all income tax and other taxes which they should properly account for under the tax jurisdiction applicable to them.
All registered language teachers certify that they can request and receive funds using PayPal in their country of residence.
Only approved language teacher profiles will be listed on MIND THE GAP EDUCATION GROUP Ltd.
The account of any language teacher which contains an unapproved profile may be closed at any time.
MIND THE GAP EDUCATION GROUP Ltd. acts as an agent to a language student for the purpose of booking lesson time with a language teacher. Any payment made by MIND THE GAP EDUCATION GROUP Ltd to a language teacher in respect of a lesson with a language student is a disbursement made by ourselves acting as agent for the language student and as such is outside the scope of VAT.
All registered language teachers must ensure students book lesson time through their MIND THE GAP EDUCATION GROUP Ltd. student account. Students must select available lesson time from a language teacher's work planner and make payment of all fees necessary to complete the booking process.
Any action or communication by a language teacher with the objective of enabling a student to avoid our fees, negotiating fees, or arranging lesson time with a student outside of MIND THE GAP EDUCATION GROUP Ltd. is strictly prohibited and will result in the closure of the account of the student and teacher concerned and legal action taken for the recovery of monies deemed owing.
All language teachers agree to complete feedback and analysis for a language student following each lesson through their MIND THE GAP EDUCATION GROUP Ltd. teacher account. We reserve the right to close the account of any language teacher who does not complete analysis for their student following each lesson.
Language teachers may cancel a lesson up to 24 hours before the lesson is due to begin. Where a language teacher cancels a lesson, any payment made by a student directly to a teacher must be refunded in full.
When booking lesson time students may choose to pay the full lesson price in advance or make only a part payment. If a student pays the full lesson price in advance, we will collect your lesson fee and credit your account. You can request payment of your credit balance at any time subject to the minimum value of 10.00 (Currency of your Country).
Following a request for payment we will pay your credit balance to your nominated PayPal or bank account within 15 working days.
Under common law we have a duty not to facilitate fraud. Payment of a credit balance will not be made in any circumstances where we have reasonable grounds to believe that the purchaser’s payment was fraudulent, made without their consent, or where we have received notification from PayPal or our bank account as our payment processor that the purchaser did not authorize the transaction.
In such circumstances payment of a credit balance will only be made once PayPal or our bank as our payment processor has confirmed the legitimacy of the transaction or 180 days since the original transaction date has expired and no transaction dispute has been raised by the purchaser within that time period. We reserve the right to deduct from a tutor’s credit balance the value of any transaction where we have reasonable grounds to believe that the purchaser’s payment was fraudulent, made without their consent, or where we have received notification from PayPal or our bank as our payment processor that the purchaser did not authorize the transaction
It is very rare that tutors encounter problems receiving payment from a student. If this should occur it is essential that you report this to ourselves as soon as possible so we can assist you.
Non payment of lesson fees must be reported to ourselves within 7 working days following the date you issued your invoice. We are not able to assist tutors who report payment problems outside of this time frame.
When reporting non payment of lesson fees, please include details of:
The username of the student
The date of the lesson
The amount outstanding
MIND THE GAP EDUCATION GROUP Ltd. reserves the right to monitor communications between users. All users consent to the monitoring of communication, via any of the functions we make available, for the purposes of protecting the integrity and security of MIND THE GAP EDUCATION GROUP Ltd. protecting users from abuse, detecting fraud and attempts to avoid our fee structure.
All users acknowledge that neither MIND THE GAP EDUCATION GROUP Ltd. is responsible for the quality of the interface or the quality of communications between users using Skype, Zoom or Google Meet.
Where there is a dispute by a registered language student over the performance, quality, duration or any other matter with respect to a language lesson or associated service delivered by a registered language teacher, a student has 24 hours following the lesson to report the problem using the lesson dispute function of their account. Any lesson which is not disputed within 24 hours using the correct procedure will be deemed successful and complete.
Where a lesson is reported within 24 hours using the correct procedure, all users agree to MIND THE GAP EDUCATION GROUP Ltd. acting as arbitrator between the language student and language teacher concerned. All users accept that the decision of MIND THE GAP EDUCATION GROUP Ltd. will be final and binding on both the language student and language teacher.
All users agree that performance of MIND THE GAP EDUCATION GROUP Ltd’s contractual obligations to registered language students and language teachers in respect of any individual lesson will be deemed complete by notification of the details of that lesson to the relevant language teacher and language student concerned via their respective MIND THE GAP EDUCATION GROUP Ltd. accounts.
Our service is on an "as is" basis without any guarantees, warranties or conditions of any kind.
MIND THE GAP EDUCATION GROUP Ltd. disclaims any implied warranties relating to the merchantability of our service or its fitness for a particular purpose. MIND THE GAP EDUCATION GROUP Ltd. warrants that your use of our service will be secure, uninterrupted, error-free, meet your requirements or that any defects in MIND THE GAP EDUCATION GROUP Ltd. will be corrected.
Language teachers may close their account at any time subject to the completion of any outstanding lessons.
Language students may close their account at any time but shall remain liable to MIND THE GAP EDUCATION GROUP Ltd. and any language teacher for any unpaid lesson fees.
MIND THE GAP EDUCATION GROUP Ltd. is owned and operated by MIND THE GAP EDUCATION GROUP Ltd. Registered in Ireland; Company No. XXXXX; Registered office: XXXXX, Dublin, Ireland.
These terms and conditions shall be governed by the laws of Ireland. The provisions of this agreement are severable. If any provision is held to be invalid or unenforceable, that provision may be removed and the remaining provisions will be enforced.

This privacy statement details the personal information we collect, how we use your information and our legal basis for processing your information in compliance with the General Data Protection Regulations (GDPR).
